Top 10 IP Pitfalls for Companies in the Digital Space

More than ever, IP protection is critical for companies operating in the digital space—but many common pitfalls can trap unwary start-ups, scale-ups, and even established companies. This talk will review the IP landscape for digital technologies and the most common issues faced in the digital space. Join the expert panel from Brion Raffoul, a premier Canadian IP boutique firm, as they look at issues arising from formal registered rights (e.g., patents, designs, and trademarks), legal risks arising outside those formal processes (e.g., from trade secrets, open source software, and data licensing) and provide strategies for navigating these pitfalls and protecting your own IP.


Natalie Raffoul, Managing Partner, Brion Raffoul. Natalie is a world-renowned expert in the patenting of software, business methods, artificial intelligence (AI) and machine learning (ML), and the legal issues surrounding such subject matter.  In 2020, she was selected by IAM Strategy 300 as a Global Leader in leading the way in the development and implementation of strategies that maximize the value of intellectual property (IP) portfolios.  She is consistently ranked among the world’s leading patent practitioners by The World Leading Patent Professional’s IAM Patent 1000 publication annually since 2014, and in 2017, shortlisted as one of seven (7) most Highly Recommended patent prosecutors in Canada, and once again shortlisted in 2019. Natalie is a lawyer (Ontario) and a Registered US and Canadian Patent Agent with a background in electrical engineering.

Dennis Haszko, Sr. Patent Counsel, Brion Raffoul. Dennis is a former USPTO Patent Examiner, and has worked both as in-house corporate patent counsel for an Ottawa-based multinational telecommunications company and for private firms in both Canada and the United States. In private practice, his experience has ranged from managing the patent departments of regional IP boutique firms in both Canada and the United States to serving as a U.S. practice specialist in Canada’s largest national law firm. More recently, Dennis served as Senior Patent Counsel and Chief Information Officer of a cloud-based IP firm with a cross-border presence.

Liz Gray, IP Lawyer, Brion Raffoul. As a member of Brion Raffoul’s patent practice, Liz’s primary focus is in drafting software patents. In particular, she focuses on patent drafting in cutting-edge fields such as AI and ML, notably for Element AI, Inc. of Montreal (recently acquired by ServiceNow).  She also assists with IP licensing matters and trademark issues and provides general legal advice around intellectual property protection.
